2. Scope
These terms apply to all purchases made through pontuskarlsson.art as well as purchases made by invoice. By placing an online order or accepting a written quotation/invoice for a large work, you confirm that you have read and accepted these terms.
Formation of contract: For works on paper, the contract is formed when we receive your payment via Stripe. For large original works sold by invoice, the contract is formed when you accept our written offer or invoice by email (or other written confirmation we specify).
3. Payment
Works on paper are purchased online via Stripe. Payment is processed securely by Stripe Payments Europe Ltd. Your card details are never stored by us.
Large original works (paintings) are sold by invoice. Payment terms are stated on the individual invoice. Ownership of the work passes to the buyer only upon receipt of full payment. Large works are not released for delivery until full payment has been received and cleared.
4. Prices and VAT
Prices for works on paper are shown in SEK for deliveries to Sweden and in EUR for deliveries to other supported countries. The currency charged at checkout is determined by your shipping country.
Countries we sell to online (works on paper): Sweden, Germany, Denmark, France, Spain, Italy, Norway, and the United Kingdom. We do not ship works on paper outside these countries unless agreed in writing.
For buyers within Sweden, Swedish VAT (25%) is included where applicable.
Norway: Prices are shown and charged in EUR. Exports to Norway are made at 0% Swedish VAT. The buyer is responsible for any import VAT, customs duties, or handling fees charged upon arrival.
United Kingdom: Exports to the UK are made at 0% Swedish VAT. The buyer is responsible for any import VAT, customs duties, or handling fees charged by the destination country upon arrival. We are not responsible for delays caused by customs clearance.
Large original works (paintings): Indicative prices on the website are shown in SEK for visitors in Sweden and in EUR for other supported countries. The amount on your invoice is agreed individually at the time of purchase.
5. Shipping
Works on paper are shipped with appropriate protective packaging. Shipping is currently included at no extra charge for supported delivery countries.
Large original works (paintings) are quoted individually after we know your delivery address (including floor access and lift availability). The artwork price shown on the website excludes delivery; shipping is quoted and invoiced separately. Delivery is scheduled only after full payment has been received.
Our standard for large works within Europe is white glove delivery (specialist art transport with you meeting the driver to carry the work in). A crate and courier option (e.g. specialist packing and road transport) may be offered on request, usually with a longer lead time.
If you arrange to view a work at home or return it under your right of withdrawal, outbound and return transport are organised by us but invoiced to you at cost - see section 6b below.
6. Right of Withdrawal
In accordance with the Swedish Distance Contracts Act (Distansavtalslagen, SFS 2005:59) and EU Directive 2011/83/EU, you have the right to withdraw from your purchase within 14 days of the date on which you receive the work, without giving any reason.
To exercise your right of withdrawal, notify us by email at inquiries@pontuskarlsson.art before the 14-day period expires. State your name, order number, and that you wish to withdraw. You must then return the work within 14 days of your notification.
Exception (commission works): The right of withdrawal does not apply to works that have been created specifically according to your instructions (commission/beställningsverk), as these constitute clearly personalised goods under Article 16(c) of EU Directive 2011/83/EU.
Works on paper (online orders)
The cost of return shipping is borne by the buyer. The work must be returned in its original or equivalent protective packaging and in the same condition as received. We recommend using a tracked and insured shipping service.
Large original works (invoice orders)
The right of withdrawal applies equally to large original paintings sold by invoice. However, due to the fragile and high-value nature of these works, the following requirements apply to any return:
- All return shipping costs are borne entirely by the buyer.
- The work must be returned using a professional art shipping service (specialist art courier with climate-controlled and vibration-protected handling). Standard postal services or general courier services (e.g. PostNord standard, DHL Express standard) are not accepted for large original works.
- The work must be packed in its original crate or packaging, or equivalent professional art packaging of the same or higher standard.
- Failure to use professional art shipping or appropriate packaging, resulting in damage to the work, will be treated as improper handling by the buyer and may result in a value reduction deduction from the refund or forfeiture of the right to a full refund.
Please contact us at inquiries@pontuskarlsson.art before arranging any return of a large original work so we can provide guidance on approved shipping partners.
7. Value Reduction
You are only liable for any diminished value of the work resulting from handling beyond what is necessary to establish its nature, characteristics, and function. If the work is returned in a damaged or deteriorated condition, including due to inadequate packaging during return shipment. We reserve the right to deduct an amount corresponding to the reduction in value from the refund.
8. Refunds
Upon receipt and inspection of a returned work, we will refund you within 14 days. Online orders (works on paper) are refunded via Stripe to the same payment method where possible. Invoice orders (large works) are refunded by bank transfer to the account you used to pay, unless we agree otherwise. For works on paper, any promotional free shipping included in the original price is handled in line with applicable consumer rules; return shipping is not reimbursed.
9. Conformity, complaints, and disputes
Under Swedish and EU consumer law, goods must conform to the contract. You have at least three years to notify us of a lack of conformity (consumer purchases). This is separate from the 14-day right of withdrawal above.
If a work arrives damaged, is defective, or does not match its description, contact us promptly at inquiries@pontuskarlsson.art. Include your order or invoice reference and photographs of any damage. We will remedy the issue in accordance with applicable law (repair, replacement, price reduction, or refund as appropriate).
These terms are governed by Swedish law. If we cannot resolve a dispute directly, Swedish consumers may refer the matter to Allmänna reklamationsnämnden (ARN). Consumers in other EU/EEA countries may contact their national consumer protection authority. The EU's former Online Dispute Resolution platform has been discontinued; use the dispute bodies available in your country of residence.
